Distance Selling Agreement

1. PARTIES
1.1. SELLER: Title: Kraken Digital Prints Website: www.krakendigitalprints.com Email: info@krakendigitalprints.com
1.2. BUYER: The user who shops on the Site and enters their information on the checkout page.
2. SUBJECT OF THE AGREEMENT
The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the digital product ordered electronically by the Buyer via the Seller's website, in accordance with the relevant consumer protection laws.
3. PRODUCT INFORMATION AND DELIVERY
Product Nature: Digital content (downloadable files in PDF, ZIP, etc. formats).
Delivery Method: Products are not physically shipped. They are activated in the "My Orders" section of the Buyer's panel or sent as a download link to the email address declared by the Buyer as soon as the payment is confirmed. Delivery Time: Instant delivery.
4. RIGHT OF WITHDRAWAL (IMPORTANT NOTICE)
In accordance with regulations for distance contracts; the consumer cannot exercise the right of withdrawal in "contracts regarding services performed instantly in electronic environment or intangible goods delivered instantly to the consumer."
The Buyer accepts that they waive this right as soon as they purchase the digital content and access the download link.
Even if the file has not been downloaded, no refund is made due to the reproducible nature of digital products.
5. GENERAL PROVISIONS
5.1. The Buyer declares that they have read and informed themselves about the basic characteristics of the product, the sales price, payment method, and delivery information.
5.2. The Seller is obliged to ensure that the digital product is accessible by the Buyer, except for technical failures.
5.3. The Seller cannot be held responsible for software incompatibilities that may occur during the use of the products.
6. PAYMENT AND SECURITY
Payments are made via secure payment systems determined by the Seller using credit card or digital wallet methods. The Buyer is personally responsible for the accuracy of the information used during payment.
7. RESOLUTION OF DISPUTES
If there is a disagreement related to this agreement, the authority that will handle it depends on the value of the dispute:
For disputes up to a certain amount (which is updated every year by the Ministry of Trade), you must apply to a Consumer Arbitration Committee. For disputes above that amount, you must go to a Consumer Court.
All of these cases will be handled in British Columbia, Canada.
8. EFFECTIVENESS
In the event of an order, the Buyer is deemed to have accepted all terms of this agreement.
